Terms & Conditions Terms & Conditions [1] Exclusive Photographer. Cheetah Design Studio (CDS) shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding. Family & friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with CDS’s duties. Family and friends may not photograph any formal/posed pictures as set up by CDS. CDS has the right to request any family and/or guest put their camera/phone away during formal, posed or ceremony pictures. [2] Deposit & Payment. A non-refundable deposit of $500 is required as a retainer at the time the wedding date is booked by the Client. All retainers are non- refundable, in the event of a date change or wedding cancellation by the Client for any reason. Retainer will be applied toward your total investment agreement. Final payment is due one week prior to the wedding date. [3] Deliverables. CDS will provide unlimited photography during the date and time contracted by the Client, subject to external variable beyond CDS control (weather, location/venue restrictions, light availability, scheduling complications due to lateness and/or willingness of individuals) Within 14 weeks of the wedding date, CDS will provide the Client with all final, edited images in high-resolution digital format. Prints and albums included with the contracted package may be delivered after this time-frame so the client can choose their images for print. CDS will not provide RAW/unedited images to the client and is not obligated to provide additional images beyond what is initially delivered. CDS works within the guideline of delivering 60-100 final images per hour of shooting. Raw/unedited images are deleted after final images are delivered. Final images will be kept on file with CDS for 2 years from the date of delivery to client. [4] Copyright & Reproductions. All photographs created by CDS are copyright protected (U.S. Copyright Law). It is a violation of federal copyright law to copy, scan, or allow photographs CDS have created to be reprinted, duplicated, digitally reproduced, copied scanned, or altered (digitally or otherwise), without CDS express written permission. The Client agrees to purchase wedding photography prints directly from CDS unless in possession of the digital negatives which can be purchased separately. The digital files remain our sole property unless purchased by the Client. [5] Clients Usage. The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than CDS. If Client is obtaining a print for newspaper announcement of the wedding, CDS authorizes Client to reproduce the print in this manner. In such event, Client shall request that the newspaper run a credit for CDS adjacent to the photograph, but shall have no liability if the newspaper refuses or omits to do so. [6] Limits of liability. If CDS cannot perform this Agreement due to a fire or other casualty, act of God, or other cause beyond the control of the parties, or due to illness, then CDS shall return the retainer to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of CDS. In the event CDS fails to perform for any other reason, CDS shall not be liable for any amount in excess of the retail value of the Client’s order. [7] Photographer. CDS may substitute another photographer to take the photographs in the event of Photographer’s illness or of scheduling conflicts. In the event of such substitution, CDS warrants that the photographer taking the photographs shall be a competent professional. [8] Standard Price List. The charges in this Agreement are based on CDS Standard Price List. This price list is adjusted periodically & future orders shall be charged at the prices in effect at the time when the order is placed.

By typing your names in this box, the photographer and clients agree to all terms and conditions stated in said contract. Any modifications of this contract must be in writing and signed by both parties.
